Clause 2. Purpose of the website

BILANZ QUALITAT® makes available to those who access www.bilanzqualitat.es (hereinafter, the “users” and the “website”, respectively) information and data (hereinafter, the “Contents” and/or “Services”) provided and created by the company itself, by means of a website of an informative nature.

Owing to the very nature of the website, its content and its purpose, it may be browsed without being a registered user. Nevertheless, in these cases too BILANZ QUALITAT® wishes to comply with its legal obligations and to regulate its use, so that users accept that, by the mere act of accessing these pages, they are subject to the terms and conditions set out in this legal notice, insofar as they apply to them.

BILANZ QUALITAT® reserves the right to modify the presentation and/or configuration of the website, as well as this legal notice, at any time. Accordingly, and given the very nature of the website, this legal notice may be modified or may include changes.

For all these reasons, and since every user (whether registered or not) accepts that this legal notice will apply to them in the version in force at the time of access, they are obliged to check it and be aware of it each time they access the website. BILANZ QUALITAT® therefore recommends reading it on each visit to the website.

Clause 3. Access to the website

Access to and use of the website by the user do not imply any obligation on the part of BILANZ QUALITAT® as regards the quality and speed of access, and it may therefore, without prior notice, modify the conditions of access or suspend access, either to the whole website or to part of it. The exercise of these powers shall in no case mean that BILANZ QUALITAT® must take responsibility for the consequences, loss or damage caused thereby.

The hardware and software needed to access the website shall be the responsibility of users; BILANZ QUALITAT® shall therefore not be liable for their operation or for any other event arising from them, nor for the rights of use or licences required for their use.

Likewise, BILANZ QUALITAT® shall bear no liability whatsoever for any anomaly, malfunction, deterioration or deletion of data or software occurring in users’ equipment or systems as a direct or indirect consequence of accessing or attempting to access the website.

The service provided by BILANZ QUALITAT® through its website is of indefinite duration, without prejudice to the possibility that it may be suspended or cancelled without prior notice.

Clause 4. Proper use of the Services

The user undertakes to use the Services diligently, properly and lawfully. In particular, and by way of example without limitation, the user undertakes to refrain from:

  • using the Services in a manner, for purposes or with effects contrary to the law, to morality and generally accepted good practice, or to public order;
  • reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Services, unless authorisation has been obtained from the holder of the corresponding rights or this is legally permitted;
  • carrying out any act that may be considered an infringement of any intellectual or industrial property rights belonging to BILANZ QUALITAT® or to third parties;
  • using the Services and information of any kind obtained through the website to send advertising or communications for commercial purposes that are contrary to the purpose of the website, or unsolicited messages addressed to a plurality of persons regardless of their purpose, or marketing or disclosing such information in any way.

The user shall be liable for any loss or damage of any kind that BILANZ QUALITAT® may suffer in connection with or as a result of a breach of any of the obligations set out above, as well as of any others included in this legal notice and/or imposed by law in relation to the use of the website.

BILANZ QUALITAT® shall at all times ensure compliance with the legal system in force and shall be entitled to interrupt the Service, at its sole discretion, and even to exclude the user from the website in the event of the alleged commission, in whole or in part, of any of the offences defined in the Código Penal (Spanish Criminal Code) in force, as well as in the event of observing conduct which, in the opinion of BILANZ QUALITAT®, is contrary to this legal notice, to the general terms and conditions of contract applicable to this website, to the law or to the rules established by BILANZ QUALITAT® or its partners, or which may disrupt the proper functioning, image, credibility and/or reputation of BILANZ QUALITAT®.

Clause 5. Intellectual and industrial property rights

All the contents of the website, such as texts, graphics, photographs, logos, icons and images, as well as the graphic design, source code and software, belong to BILANZ QUALITAT® or, where applicable, to third parties whose rights it lawfully holds, and in both cases are protected by national and international legislation.

The use for commercial purposes of any elements subject to industrial and intellectual property is strictly prohibited, as is their distribution, modification, alteration or decompilation.

Infringement of any of the aforementioned rights may constitute a breach of these provisions, as well as an offence punishable under articles 270 et seq. of the Código Penal.

Users who send observations, opinions or comments to the website by email or by any other means are deemed to authorise BILANZ QUALITAT® to reproduce, distribute, publicly communicate and transform them, and to exercise any other exploitation right over them. This authorisation is granted free of charge, shall last for as long as it remains in force under the applicable legislation and shall have no territorial limitation.

Clause 6. User-generated content

BILANZ QUALITAT® makes various forms and means of participation available to all users of the website in order to encourage conversation and the exchange of information. Accordingly, all users undertake not to use these sections for any purpose prohibited by this legal notice. Each user is responsible for all of their activity relating to the Service. In addition, users must comply with all applicable laws and regulations, both national and international, and, if they represent a company, with the advertising, marketing, privacy or other self-regulatory codes applicable to their sector.

Specifically, the rules of conduct are as follows:

1. The user undertakes to comply with the terms and conditions of this legal notice and the community rules, as well as with all local, national and international laws and regulations.

2. The user undertakes not to impersonate any other person or organisation; otherwise, they may commit an offence defined in the Código Penal or other infringements of the Spanish legal system.

3. The user undertakes not to use disrespectful or offensive language. Messages containing threats, serious insults or any other type of comment that may offend the sensibilities of other users will not be accepted. In such cases, BILANZ QUALITAT® reserves the right to remove any content that contravenes this condition.

4. The user undertakes not to interfere with security-related features of the service that prevent or restrict the use or copying of any content. Furthermore, the use of this website as a means of organising attacks or sending spam against any other service is strictly prohibited. Content of this kind will be deleted together with the accounts that carried out such action.

5. The administrators of the service are entitled to delete or edit any content and/or user account that breaches any of the rules and obligations described in this legal notice or that BILANZ QUALITAT® may consider inappropriate.

Clause 7. Exclusion of warranties and liability

BILANZ QUALITAT® is not responsible for the truthfulness, accuracy and quality of this website or of its services, information and materials. These services, information and materials are presented as they are and are accessible without warranties of any kind.

BILANZ QUALITAT® reserves the right to interrupt access to the website at any time and without prior notice, as well as the provision of any or all of the Services provided through it, whether for technical, security, control or maintenance reasons, owing to power supply failures or for any other justified reason.

Consequently, BILANZ QUALITAT® does not guarantee the reliability, availability or continuity of its website or of the Services, and their use by the user is therefore at the user’s own risk, without BILANZ QUALITAT® being held liable in this respect at any time.

BILANZ QUALITAT® shall not be liable in the event of interruptions to the Services, delays, errors, malfunctions and, in general, other inconveniences originating from causes beyond its control, due to wilful misconduct or negligence on the part of the user and/or originating from unforeseeable circumstances or force majeure.

Without prejudice to the provisions of article 1105 of the Código Civil (Spanish Civil Code), force majeure shall be deemed to include all events occurring beyond the control of BILANZ QUALITAT®, such as failures by third parties, operators or utility companies, acts of Government, lack of access to third-party networks, acts or omissions of public authorities, events resulting from natural phenomena, power cuts, etc., and attacks by hackers or third parties specialising in the security or integrity of the computer system, provided that BILANZ QUALITAT® has adopted reasonable security measures in line with the state of the art.

In any case, whatever the cause, BILANZ QUALITAT® shall accept no liability whatsoever for direct or indirect damage, actual loss and/or loss of profit.

BILANZ QUALITAT® excludes any liability for loss or damage of any kind that may be due to a lack of truthfulness, accuracy, completeness and/or timeliness of the Services transmitted, disseminated, stored, made available, received or obtained through the website or accessed through it, as well as for the Services provided or offered by third-party persons or entities.

BILANZ QUALITAT® shall endeavour, as far as possible, to update and correct any information hosted on its website that does not meet minimum guarantees of truthfulness. However, it shall be exempt from liability for failure to update or correct it, as well as for the contents and information posted on it. In this respect, BILANZ QUALITAT® is under no obligation to monitor, and does not monitor, the contents transmitted, disseminated or made available to third parties by users or partners, except where required by the legislation in force or by a competent judicial or administrative authority.

Likewise, BILANZ QUALITAT® excludes any liability for loss or damage of any kind that may be due to the presence of viruses or other harmful elements in the contents that may cause alterations to computer systems, or to the documents or systems stored on them.

Nor is it responsible for the use that the user makes of the Services of the website, of their passwords or of any other material on it where such use infringes intellectual or industrial property rights or any other third-party rights.

The user undertakes to hold BILANZ QUALITAT® harmless against any damage, loss, penalty, expense (including, without limitation, legal fees) or civil, administrative or other liability that BILANZ QUALITAT® may suffer in connection with the user’s breach, or partial or defective performance, of the provisions of this legal notice or of the applicable legislation and, in particular, of the user’s obligations relating to the protection of personal data set out in this legal notice or established in the Regulation (EU) 2016/679 (GDPR) and Ley Orgánica 3/2018 (the Spanish Data Protection Act, LOPDGDD) and its implementing regulations.

Clause 8. Links to other websites

BILANZ QUALITAT® neither guarantees nor accepts any liability for loss or damage suffered as a result of accessing third-party Services or contents through connections, links or hyperlinks of the linked sites, nor for their accuracy or reliability.
